Provider: ViberNet (a division of Scaled Holdings India Private Limited)
These Terms of Use (“Agreement”) govern provision and use of ViberNet internet and related services (“Service”) by the person or entity that subscribes (“Customer”, “you”). By subscribing, using, or permitting use of the Service you accept and agree to be bound by this Agreement.
1. Definitions

Service — any internet access, broadband, Wi-Fi, IPTV, managed CPE, or related services ViberNet supplies.

CPE / Device(s) — Customer Premises Equipment (routers, ONT/ONT + STB, Wi-Fi units, PoE devices, decoders, etc.) physically installed at Customer Premises by or on behalf of ViberNet.

Account — the billing / subscriber record created for the Customer.
2. Scope of Service and Activation

ViberNet will provide the Service subject to technical feasibility and availability in your area, and after acceptance of your order and any required security deposit or activation fee. (Network feasibility and activation terms vary by plan.)
3. Charges, Billing & Payment

You agree to pay all applicable one-time charges (installation, activation), recurring monthly charges, taxes (e.g., GST), surcharges and any other fees connected with your Service. Certain plans may require an advance, refundable security deposit or activation fee.

Bills are due as per the invoice. Failure to pay by the due date may lead to late fees, service suspension, or termination as described below.
4. Installation, Ownership of Devices, and Access

ViberNet (or its authorized agent) will install CPE required for provision of Service. A non-refundable or refundable installation/activation charge may apply as per plan.

Ownership: All devices installed by ViberNet remain the sole property of ViberNet unless expressly stated otherwise in a separate written agreement. Customer shall not sell, mortgage, encumber, or transfer title to such devices. This includes routers, ONTs, set-top boxes, Wi-Fi units, and any accessories provided at installation.

Access for Maintenance / Recovery: Customer must allow ViberNet reasonable access to premises for installation, maintenance, inspections, upgrades, repairs, upgrades, or recovery of its devices. If Customer refuses reasonable access or vacates premises without returning ViberNet devices, ViberNet may recover the devices and charge reasonable recovery costs.
5. Non-Recharge / Inactive Account Device Recovery

If an account is prepaid or requires periodic recharge/top-up and the Customer fails to recharge or renew service for a continuous period of 90 (ninety) days, ViberNet may treat the account as terminated for operational purposes, reclaim its installed devices from the Customer premises, and retain any applicable deposits against outstanding dues or device recovery costs. ViberNet will attempt to notify the Customer by SMS, e-mail, or registered contact before device recovery where reasonably possible. The Customer agrees devices will be collected and that title remains with ViberNet. (This is in addition to any applicable suspension/termination rights for unpaid bills.)

Recovery after 90 days may include a physical collection visit and/or collection through authorized service partners. Reconnection after recovery is at ViberNet’s discretion and may require fresh installation/activation charges.

6. Suspension and Termination

Suspension: ViberNet may suspend Service (without refund) for non-payment, suspected fraud or abuse, legal/regulatory directions, technical reasons, or breach of this Agreement.

Termination: ViberNet may terminate the Service for repeated non-payment, material breach, insolvency of the Customer, or other legitimate business reasons. Upon termination you must return all ViberNet devices; ViberNet may charge for unreturned devices and any costs incurred in recovery.
7. Acceptable Use Policy (AUP)

Customer must not use the Service for illegal activities (e.g., hacking, spamming, piracy), to harm network integrity, or to disrupt other users. ViberNet may limit bandwidth or service for traffic that impacts network performance (e.g., excessive P2P traffic) or for violation of this AUP.
8. Customer Responsibilities

Provide correct identification and contact details and keep them updated.

Ensure internal wiring and in-home equipment comply with safety standards; ViberNet is not liable for damage caused by third-party equipment.

Pay charges on time and allow access to premises for installation, maintenance or device retrieval.
9. Service Levels, Liability & Indemnity

ViberNet will use reasonable efforts to provide continuous Service but does not guarantee uninterrupted or error-free operation. Service levels, where offered, are subject to network constraints and force majeure.

Limitation of Liability: To the fullest extent permitted by law, ViberNet’s liability for any claim arising out of provision or failure of Service is limited to direct damages not exceeding the amount paid by Customer for the Service in the preceding three (3) months (or such cap as may be prescribed by applicable law). ViberNet is not liable for indirect, incidental, special or consequential damages (including loss of business, data or goodwill).

Indemnity: Customer shall indemnify and hold ViberNet harmless against claims arising from Customer’s breach, illegal use of Service, or failure to return ViberNet property.
10. Privacy & Data

ViberNet will collect personal data to provide Service (KYC, billing, trouble-ticketing). Use of data is governed by ViberNet’s Privacy Policy. ViberNet may disclose information as required by law or lawful authority.
11. Intellectual Property

All network software, tools, and documentation provided by ViberNet are ViberNet’s intellectual property. Customer may not copy or reverse engineer such software except with prior written permission.
12. Changes to Terms

ViberNet may amend these Terms; changes applicable to existing Customers will be notified by e-mail, SMS, or posted on vibernet.in (or the account portal). Continued use after notice binds Customer to amended Terms.
13. Dispute Resolution & Governing Law

This Agreement is governed by the laws of India. Parties will attempt to resolve disputes amicably; unresolved disputes may be subject to arbitration or courts as per ViberNet’s standard dispute policy and applicable law.
14. Complaints & Support
-
For support, billing disputes, or device recovery questions contact ViberNet Customer Support (contact details will be provided on invoices and the website). ViberNet will follow its published complaint resolution timelines and escalation matrices.
15. Miscellaneous

Force Majeure: ViberNet is not liable for failures caused by events beyond reasonable control (natural disasters, strikes, regulatory actions).

Severability: If any provision is invalid, the rest remain in effect.

Entire Agreement: This Agreement (plus any plan-specific terms, activation forms and the Privacy Policy) constitutes the full agreement between Customer and ViberNet.
